1. Acceptance
By accessing or using Kept AI (the “Service”), operated by FINGERPOWER DIGITAL TECHNOLOGY LLC (“Company”, “we”, “us”, or “our”), you agree to these Terms of Use (“Terms”). If you do not agree, do not use the Service.
2. The Service
Kept AI provides AI search visibility (GEO) analytics: prompt tracking across supported AI surfaces, visibility and source reports, Agent analytics via Kept Gateway, and related tools described on www.keptai.com and in the application at app.keptai.com. Outcomes in third-party AI products depend on factors we do not control. We do not warrant that any AI system will mention, cite, or rank your brand.
3. Accounts
You are responsible for safeguarding your credentials and for activity under your account. Notify us at support@keptai.com if you suspect unauthorized use. You must be at least 18, or the age of majority in your jurisdiction, to create an account.
4. Subscriptions and payment
Self-serve plans (Starter, Pro, Advanced) are billed in U.S. dollars, monthly or annually, and renew automatically until you cancel. Payments are processed by Stripe. Fees are exclusive of applicable taxes. Enterprise plans are quoted separately and billed under their order form.
Self-serve plans include a 7-day free trial. A payment method is required at sign-up. When the trial ends, the subscription converts to a paid plan unless you cancel first. One trial is available per account.
5. Cancellation and refunds
You may cancel at any time from the billing page. Cancellation stops the next renewal; access continues until the end of the paid period. Refunds are described in our Refund Policy.
6. Availability
We use commercially reasonable efforts to keep the Service available and will give advance notice of planned maintenance when we can. We do not commit to a contractual uptime percentage.
7. Acceptable use
You agree not to:
- Use the Service to scrape, mirror, or republish third-party content in violation of law or that party’s terms;
- Attempt to disrupt, reverse-engineer, or gain unauthorized access to the Service;
- Use the Service to generate or distribute illegal, defamatory, infringing, or malicious content;
- Send spam, phishing content, or facilitate fraud;
- Resell or relicense the Service without our prior written consent.
8. Intellectual property
The Service, including its software, branding, and documentation, is owned by FINGERPOWER DIGITAL TECHNOLOGY LLC. You retain ownership of the content you provide; you grant us a non-exclusive, worldwide, royalty-free license to process that content solely to deliver and improve the Service.
9. Third-party services
The Service uses processors listed in the Privacy Policy, including hosting, payments, sampling, and model providers. We are not responsible for their practices, availability, or terms. Your use of any third-party service is governed by that party’s terms.
10. Disclaimers
The Service is provided “AS IS” and “AS AVAILABLE” without warranties of any kind, including merchantability, fitness for a particular purpose, and non-infringement. Analytics depend on third-party AI systems that change without notice.
11. Limitation of liability
To the maximum extent permitted by law, FINGERPOWER DIGITAL TECHNOLOGY LLC and its officers, members, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill. Our total aggregate liability for any claim shall not exceed the greater of (a) the fees you paid us in the twelve (12) months preceding the event or (b) US$100.
12. Indemnification
You agree to defend, indemnify, and hold harmless FINGERPOWER DIGITAL TECHNOLOGY LLC from claims arising out of your use of the Service, your content, or your violation of these Terms.
13. Termination
We may suspend or terminate access for breach of these Terms, for risk to other users or to the Service, or for any reason with reasonable notice. Sections that by their nature should survive termination shall survive.
14. Changes
We may modify these Terms from time to time. The “Last updated” date will indicate when changes were made. Material changes will be announced by email or in-app notice. Continued use after changes take effect constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-law rules. The parties consent to the exclusive jurisdiction of the state and federal courts located in Jefferson County, Colorado.
